Terms of Service

Effective date: 13 October 2025

Applies to: the Sentinel websites, apps, SDKs, APIs, the decentralized VPN ("dVPN") client and node marketplace, and the Sentinel Scout AI data layer (together, the “Services”).

Legal Entity: Sentinel Technologies Ltd, Intershore Chambers, Road Town, Tortola, VG 1110, British Virgin Islands.

1. Acceptance & Eligibility

By using the Services, you agree to this ToS and our Privacy Policy. If you use the Services on behalf of an entity, you represent you have authority to bind that entity. Minimum age: 18+ (or higher where required). The Services are not directed to children.

2. Accounts, Wallets & Access

Some features require an account, a supported wallet, or authenticated API access. Keep credentials and private keys secure; you are responsible for all activity under your account/wallet/API keys. We do not custody your private keys if you authenticate with a wallet.

3. Software License & Open Source

Client apps and SDKs are licensed (not sold) under the licenses that accompany them and may contain open‑source components under their respective licenses. Except where permitted by law or license, do not reverse engineer, circumvent security, resell, or provide unauthorized access.

4. Service Overview & Product-Specific Notes

4.1 dVPN

  • The dVPN routes traffic through a decentralized marketplace of independent node operators ("Node Operators"). Sentinel facilitates discovery, payments, and quality controls but does not operate every node.
  • No activity logs at control plane: We do not log the contents of your traffic or the specific destinations you visit. Minimal session/accounting data needed for routing, metering, fraud prevention, and abuse mitigation may be processed ephemerally and/or in aggregate (see Privacy Policy).
  • Protocols: Supported tunneling/proxy protocols (e.g., WireGuard, v2ray) are provided "as is" and may have third‑party dependencies.
  • Node Types: Marketplace nodes may include data‑center and residential egress offered under separate plans/subscriptions. Your traffic egresses from the jurisdiction where your chosen node is located.

4.2 Sentinel Scout — AI Data Layer & APIs

  • Purpose: Ingestion of public‑web and user‑contributed datasets; indexing, enrichment/ETL, provenance, retrieval, and optional training flags.
  • Your Data Duties: You must have rights to collect, process, and share any data you ingest; honor robots.txt and site terms; comply with privacy/IP laws; and avoid sensitive/personal data unless you have a lawful basis and any required consents.
  • License to Process: You grant Sentinel a non‑exclusive, worldwide, royalty‑free license to host, cache, analyze, index, transform, and display your submitted datasets and to create derived indexes solely to provide and improve the Services.
  • “Do‑Not‑Train” & Controls: Where offered, dataset‑level flags can exclude contributed datasets from model training. Indexing necessary to provide retrieval to you still applies.
  • Keys & Credentials: Third‑party API keys you supply (e.g., search providers) are stored securely and used only to execute your jobs; you remain responsible for their terms, quotas, and costs.
  • Fair Use: We may enforce rate limits, quotas, and anti‑abuse controls.

5. Payments, Credits & Tokens

Plan features, metering units (e.g., GB of bandwidth, query units), and prices are shown at purchase or in your dashboard; taxes may apply. If you opt into on‑chain settlements/incentives (e.g., for Node Operators), you acknowledge crypto assets are volatile and transactions may be irreversible. Sentinel does not provide investment advice. Unless required by law, fees are non‑refundable. Chargebacks, fraud, or abuse may result in suspension.

6. Acceptable Use Policy (AUP)

You must not use the Services to: (a) violate law; (b) infringe IP or privacy; (c) distribute malware/spam/DDoS; (d) access or probe others’ systems or data without permission; (e) evade export/sanctions controls; (f) engage in harassment, child sexual abuse material, or other egregious content; (g) interfere with network integrity or quality; (h) run high‑risk services or crypto mining on community nodes without explicit permission; (i) attempt to deanonymize other users. We may suspend accounts that breach the AUP or pose risk to users, networks, or partners.

7. Node Operator Addendum (Summary)

Operating a node via the marketplace requires you to: (i) maintain up‑to‑date security and reasonable safeguards; (ii) avoid activity logging except minimal metrics necessary for uptime/billing; (iii) act promptly on abuse reports and lawful requests applicable in your jurisdiction; (iv) accurately report capacity/uptime and not falsify metrics; (v) comply with telecom/export/tax rules; (vi) not misrepresent yourself as Sentinel’s agent or grant warranties on our behalf. Full Node Operator Terms apply separately.

8. Third-Party Services

The Services may integrate third‑party nodes, software, app stores, or payment processors. Sentinel is not responsible for third‑party terms, practices, outages, or data handling.

9. Intellectual Property & Feedback

We and our licensors own the Services and related IP. You retain rights in your content/datasets. By submitting feedback, you grant Sentinel a perpetual, worldwide, royalty‑free license to use it without obligation.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. We do not guarantee anonymity, unbreakable security, continuous availability, particular speeds, geolocation consistency, or the accuracy of AI outputs.

11. Limitation of Liability

To the extent permitted by law, Sentinel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, or loss of data, even if advised of the possibility. Our aggregate liability for all claims in any 12‑month period shall not exceed the greater of USD $100 or the amounts you paid to Sentinel for the Services in that period.

12. Indemnification

You will defend and indemnify Sentinel against claims arising from your misuse of the Services, your breach of this ToS, or your infringement of third‑party rights, including reasonable attorneys’ fees, subject to applicable law.

13. Suspension, Termination & Survival

You may stop using the Services at any time. We may suspend or terminate access for AUP breaches, non‑payment, legal risk, or to protect the network. Upon termination, your license ends and you must cease use. Sections concerning IP, fees due, disclaimers, limitations, indemnities, and dispute resolution survive.

14. Changes

We may modify the Services and this ToS. For material changes, we will provide notice (e.g., in‑product, email, or website). Continued use after the effective date constitutes acceptance.

15. Governing Law & Dispute Resolution (JVI)

This ToS is governed by the laws of the British Virgin Islands (BVI), without regard to conflict‑of‑laws principles. You agree to the exclusive jurisdiction and venue of the courts located in the British Virgin Islands. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect IP or the security/integrity of the Services.

16. Export & Sanctions

You represent you are not subject to embargoes/sanctions and will not use the Services in prohibited countries or for prohibited end‑uses (e.g., WMD, restricted military end‑use).
